Far — Terms of Service

These Terms are an agreement between you and [LEGAL ENTITY NAME, ADDRESS] ("Far", "we"). By creating an account or using Far you agree to them and to the documents they incorporate: the [Privacy Policy], the [Outdoor Safety, Navigation & Emergency-Use Disclaimer] (Section 8 — read it; it matters for your safety), the [AI Features Disclosure], the [Cookie Policy], and the [Copyright Policy].
1. The service
Far is planning software for backpacking and outdoor trips: maps, route drawing, weather lookups, gear inventory and packing lists, permit and alert lookups, GPX import/export, and AI-assisted planning. Far is an information and planning tool only. It is not a navigation device, not an emergency service, not a source of verified trail conditions, and not a substitute for skill, preparation, and judgment in the outdoors.
2. Your account
You must be at least [16] years old. You are responsible for the security of your email account and Google account, since they are how you sign in to Far. Keep your contact email current. You may not share, sell, or transfer your account.
3. Plans, trials, and billing
- Free plan: includes up to [2] trips, [1] GPX import, and [5] lifetime AI-assistant questions. If you exceed a limit (for example after a trial ends), your data is never deleted — trips beyond the limit become read-only until you upgrade or remove others.
- Trial: new accounts receive a [7]-day trial of Pro features, starting at sign-up. No payment method is required, and nothing is charged when the trial ends — you simply drop to the Free plan. [UPDATE THIS CLAUSE WHEN CARD-UPFRONT TRIALS OR BILLING LAUNCH.]

- Prices, once introduced, may change with at least [30] days' notice, effective at your next renewal.
4. Your content
You keep ownership of everything you create or upload: trips, routes, waypoints, gear lists, notes, photos, and GPX files ("Your Content"). You grant Far a non-exclusive, worldwide, royalty-free license to host, store, process, display, and transmit Your Content solely to operate and improve the service for you — for example storing your photos, rendering your route on a map, sending trip details to our AI provider when you invoke an AI feature, or displaying a gear list at a share link you enabled. This license ends when you delete the content or your account, except for content you have shared publicly that others have already copied, and short-lived backups.
We do not use Your Content for advertising and do not permit our AI providers to train models on it.
If you enable a public share link for a trip's gear list, you are publishing that gear list to anyone who has the link, and you are responsible for what it contains.
5. Acceptable use
You may not:
- access another person's data, probe, scan, or test the vulnerability of the service without written authorization, or circumvent rate limits, plan limits, or access controls;
- upload malware or files that misrepresent their type; automate bulk scraping of the service or its data feeds;
- use Far to harass, stalk, or track any person, or to plan unlawful activity — including publishing someone else's location or planned whereabouts without consent;
- upload content that infringes others' rights (copyright, privacy, publicity) — this includes GPX tracks and maps you do not have the right to redistribute;
- misrepresent AI-generated plans as verified, official, or professionally reviewed information when sharing them;
- resell or white-label the service without a written agreement.
We may suspend or terminate accounts that violate these rules, with notice where practicable. You may stop using Far and delete your account at any time.
6. Third-party services and data
Far displays data from third parties: map imagery (Mapbox, Esri, OpenStreetMap contributors and others), weather (Open-Meteo), trail data (OpenStreetMap/Overpass, Waymarked Trails), park alerts and permits (US NPS, Recreation.gov, Parks Canada, BC Parks), and AI-generated content (Groq-hosted models). This data is provided "as is" from its sources; attribution and license notices are at [/legal/attributions]. Your use of Google sign-in is subject to Google's terms.
7. AI features
AI outputs (trip plans, gear suggestions, permit and alert summaries, weight estimates) are machine-generated and can be wrong, outdated, or incomplete — see the [AI Features Disclosure]. AI-estimated values are visibly marked until you confirm them. Verify anything safety-critical against official sources before relying on it.
8. Assumption of risk; safety disclaimer
Backpacking and wilderness travel are inherently dangerous. Weather changes, trails wash out, water sources dry up, GPS and devices fail, and rescue can be hours or days away. By using Far you acknowledge that you rely on any information in the app — routes, distances, elevation, hiking-time estimates, weather forecasts, water or campsite markers, permit and alert information, and AI-generated content — at your own risk, and that you remain solely responsible for your own preparation, equipment, navigation, and decisions in the field. Far is not designed or licensed for emergency use and must never be your means of calling for help. The full disclaimer at [/legal/safety] is part of these Terms.
9. Disclaimer of warranties
The service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement, to the maximum extent permitted by law. We do not warrant that the service will be uninterrupted, error-free, or that any data (including maps, weather, and AI output) is accurate or current.
10. Limitation of liability
To the maximum extent permitted by law: (a) Far is not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, profits, or goodwill; (b) Far's total liability for all claims arising from the service is limited to the greater of [US $50] and the amount you paid us in the 12 months before the claim; and (c) Far is not liable for injury, death, or property damage arising from outdoor activities you undertake, to the extent such a limitation is enforceable in your jurisdiction.
Consumer-law carve-out: nothing in these Terms limits rights that cannot be limited by law, including your statutory consumer guarantees under the Australian Consumer Law and New Zealand Consumer Guarantees Act, non-excludable rights under EU and UK consumer law, Quebec consumer protection rules, and liability for gross negligence, willful misconduct, or death or personal injury caused by our negligence where such liability cannot lawfully be excluded.
11. Indemnity
If a third party brings a claim against Far arising from Your Content or your breach of these Terms, you will indemnify Far against the resulting costs and damages, except to the extent we caused them. [COUNSEL: consumer-jurisdiction enforceability review.]
12. Termination
You can delete your account at any time in Settings; deletion is permanent. We may suspend or terminate for material breach with [14] days' notice and a chance to cure where the breach is curable, or immediately for serious abuse (Section 5), illegal content, or risk to other users or the service. On any termination we will, on request and for [30] days, make your data available for export unless legally prohibited.
13. Changes to the service or terms
We may change the service and these Terms. For material changes to the Terms we will give at least [30] days' notice by email or in-product message; if you don't agree, you may terminate and, if you prepaid, receive a pro-rata refund for the unused period. Continued use after the effective date is acceptance.
14. Governing law and disputes
